Camtasia for ChatGPT Terms of Service

1. Introduction

Please read these Terms of Service (“Terms”) carefully as they are the legal terms and conditions that you agree to when you use the Camtasia app for ChatGPT (the “Service”), provided to you by TechSmith Corporation (“TechSmith”) through OpenAI’s ChatGPT Apps platform. The service includes optional features that use third-party generative artificial intelligence platforms (the “Generative AI Features”) and text-to-speech generation (“TTS”, and the related features, the “TTS Features”).

By installing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Operator

This Service is operated by TechSmith Corporation (“TechSmith”), a company incorporated under the laws of the State of Michigan whose principal business address is 14 Crescent Road, East Lansing, MI 48823-5708 U.S.A. TechSmith is also referred to in these Terms as “we” and “us”.

3. Purpose of the Service

The Service helps you generate animated, narrated screencasts from screenshots and prompts, directly inside ChatGPT. It works by combining several components:

• A large language model (provided by OpenAI as part of ChatGPT) that interprets your prompts and helps generate scripts and storyboards.
• TTS Features that produce synthetic narration audio.
• A video rendering pipeline that assembles images, animations, and audio into a finished screencast.

Generated videos can be previewed in ChatGPT and, if you choose, opened in Camtasia Online for further editing. Use of Camtasia Online is governed by the Camtasia and Screencast Terms Service (https://www.techsmith.com/trust-center/screencast-camtasia-online-tos/), which apply separately.

4. Relationship to ChatGPT

The Service is distributed through OpenAI’s ChatGPT Apps platform. Your use of ChatGPT itself, including any data ChatGPT collects from your interactions, is governed by OpenAI’s terms and privacy policy. We do not control the OpenAI side of that experience and are not responsible for it.

Usage of this service is also limited to the usage policies laid out by OpenAI
(https://openai.com/policies/usage-policies/).

OpenAI, ChatGPT, and related icons are the property of OpenAI, and the use of those names in these Terms is not an endorsement, sponsorship, or affiliation beyond TechSmith’s distribution of the Service through OpenAI’s platform.

5. Availability

TechSmith uses reasonable endeavors to ensure that the Service is available 24 hours a day, 7 days a week. However, the Service will sometimes be interrupted for maintenance, upgrades, fixes, or due to the failure of third-party providers, telecommunications links, or equipment that is beyond our control. We will take reasonable steps to minimize disruption where it is within our reasonable control. You agree that TechSmith is not liable to you for any modification, suspension, or discontinuance of the Service. We reserve the right to modify or terminate the Service for any reason and without notice at any time.

6. Privacy

TechSmith has a firm commitment to safeguarding your privacy. The terms of TechSmith’s privacy policy (https://www.techsmith.com/privacy-policy.html) are incorporated into, and considered part of, these Terms.

7. Use of the Generative AI Features and TTS

As described above, the Service contains Generative AI Features and TTS Features that aid in the creation of Content. By configuring and using these features, you expressly consent to your Content being shared by TechSmith for processing by its designated technology providers, including OpenAI and TechSmith’s TTS provider(s). You further grant to TechSmith an
unrestricted, perpetual, non-exclusive, fully-paid, and royalty-free license, with the right to sublicense any such rights to TechSmith’s contractors supporting the Generative AI Features and TTS Features, to reproduce, distribute, display, transmit, and otherwise use your Content solely as necessary to provide the Service.

TechSmith will not use your submitted Content to train AI models without your consent.

You also understand and agree that:

• Voices used for narration are AI-generated and do not represent real people. Voice options are provided as creative tools, not as endorsements by any individual.
• You are responsible for the scripts and other inputs you submit. Do not use the Service to generate audio or video that impersonates a real person, defames anyone, or otherwise violates someone’s rights.
• Voice availability, audio quality, supported languages, and underlying providers may change over time as we update or swap providers.

You are prohibited from using web scraping, web harvesting, or web data extraction methods to extract data from the Generative AI Features or TTS Features.

8. Output Quality

Outputs from the Service (scripts, narration, animations, and rendered videos) are produced by AI and may contain errors, inaccuracies, or unexpected results. You should review outputs before sharing or publishing them. The Service is a creative tool, not a source of authoritative information.

9. Trademarks

All brand, product, and service names used in this Service which identify TechSmith or third parties and their products and services are proprietary marks of TechSmith and the relevant third parties. Nothing in this Service shall be deemed to confer on any person any license or right with respect to any such image, logo, or name.

10. Intellectual Property in the Service

TechSmith, unless otherwise stated, is and shall remain the owner of all intellectual property rights, including copyright, patent, and database rights in the Service and TechSmith-created and owned content used in connection with providing the Service. You may not publish, distribute,
extract, re-utilize, or reproduce any component of the Service or TechSmith-created and owned content other than in accordance with these Terms.

11. Your Content

“Content” means the inputs you submit to the Service (such as screenshots, prompts, scripts, voice selections, and reference materials) and the outputs the Service produces for you (such as storyboards, scripts, audio narration, and rendered videos).

You own your Content, subject to the rights of any third parties whose material may appear in your inputs. You are responsible for making sure you have the right to use your Content. You must have the legal right to copy, display, and use each Content screenshot, image, script, or other input you provide to the Service.

The license you grant TechSmith to process Content through the Generative AI Features and TTS Features is described in the section above. TechSmith may also review and analyze Content that is generated, displayed, or edited within TechSmith-provided interfaces, including the storyboard editor, to understand how the Service is being used and to improve product quality, performance, and user experience. TechSmith does not use your Content to train AI models or share it with third parties for their own training purposes.

12. Conduct

You agree not to use the Service:

• For any unlawful purposes;
• To submit, generate, or transmit any material that is obscene, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, or illegal;
• To submit, generate, or transmit any material that you do not have a right to use, or that infringes any copyright, trademark, patent, or other intellectual property right of any party including TechSmith;
• To harm minors in any way, including content that violates child protection laws;
• To generate audio, video, or other content that impersonates a real person in a misleading way, including for the purposes of fraud, harassment, or political deception;
• To submit any material likely to cause harm to TechSmith or anyone else’s computer systems, including viruses, worms, or files designed to damage or allow unauthorized access to the Service.

You also agree not to:

• Interfere with or disrupt (or attempt to interfere with or disrupt) the Service or servers or networks connected to the Service, or to disobey any requirements of networks connected to the Service;
• Probe, scan, or stress-test the Service in ways that degrade performance for other users;
• Reverse engineer the Service or use the Generative AI Features to discover any of the underlying components of the models, algorithms, or systems, including extracting model weights;
• Use automated tools to scrape outputs or bypass usage limits;
• Provide any information to TechSmith that is false or misleading or that you do not have the right to disclose.

Violation of any of these provisions may result in suspension or termination of your access to the Service.

13. Suspension, Modification, and Termination

You agree that TechSmith may at any time without notice:

• Refuse to provide the Service to you;
• Modify, suspend, or discontinue any part of the Service;
• Terminate your access if, in TechSmith’s sole discretion, you fail to comply with these Terms or if a competent regulatory authority requires us to do so;
• Terminate your access if your use of the Service is deemed to be excessive or unreasonable.

You may stop using the Service at any time by uninstalling or disconnecting the app in ChatGPT.

14. Disclaimer of Warranty and Limitation of Liability

TechSmith agrees that all services will be carried out with reasonable skill and care.

THE SERVICE, TECHSMITH’S SITES, AND ALL RELATED PRODUCTS AND SERVICES ARE PROVIDED BY TECHSMITH “AS IS” WITH NO WARRANTIES WHATSOEVER. ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE EXPRESSLY DISCLAIMED. TO THE FULLEST EXTENT PERMITTED BY LAW, TECHSMITH DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THIS SERVICE AND ANY OUTPUTS GENERATED BY THE GENERATIVE AI FEATURES OR TTS FEATURES.

BY WAY OF CLARITY, TECHSMITH OFFERS NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, RELATED TO INTELLECTUAL PROPERTY OR OTHER RIGHTS IN YOUR CONTENT, WHETHER CONSIDERED PROMPTS, INPUTS, OUTPUTS, OR YOUR CONTENT, AND YOUR USE OF CONTENT IN CONNECTION WITH THE SERVICE IS AT YOUR OWN RISK WITH REGARD TO ALL SUCH RIGHTS. TECHSMITH DOES NOT REPRESENT OR WARRANT THAT YOUR CONTENT WILL BE ERROR FREE OR THAT SUCH CONTENT SHALL NOT INFRINGE THIRD PARTY RIGHTS, INCLUDING WITHOUT LIMITATION PRIVACY AND INTELLECTUAL PROPERTY RIGHTS. TECHSMITH DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL BE FREE FROM THIRD PARTY INTERFERENCE OR OTHERWISE SECURE.

EXCEPT AS EXPRESSLY PROVIDED IN THE PRECEDING PARAGRAPH, TO THE
FULLEST EXTENT ALLOWED BY LAW, TECHSMITH SHALL NOT BE LIABLE FOR
ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES RESULTING FROM THE USE OR PROVISION OF THE SERVICE, EVEN IF TECHSMITH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMERS, WAIVERS, AND LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

15. Amendment of the Terms

TechSmith reserves the right to amend these Terms from time to time without notice to you. You can review the most current version of these Terms at any time at https://www.techsmith.com/trust-center/camtasia-for-chatgpt-tos.

16. Applicable Law and Jurisdiction

These Terms shall be governed by the laws of the State of Michigan, U.S.A., to the extent U.S. federal laws are not applicable, without regard to their conflicts of law principles. The application of the United Nations Convention on Contracts for International Sale of Goods is expressly excluded. You agree to the exclusive jurisdiction of the Courts of the State of Michigan, U.S.A. and the United States federal district court located in Ingham County,
Michigan, U.S.A. This Agreement has been prepared in the English language and such version shall be controlling in all respects; any non-English version of this Agreement is solely for accommodation purposes. The parties to this Agreement waive personal service of any and all process upon them and consent that all such service of process be made by registered mail and
shall be deemed to be completed 5 business days after the same shall have been deposited in the United States mail, postage prepaid. You waive any objection based on forum non conveniens and any objection to venue of any action instituted under these Terms by TechSmith in any jurisdiction.

17. General

These Terms constitute the entire agreement between TechSmith and you with respect to your use of the Service. TechSmith’s failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court should find that one or more rights or provisions contained in these Terms is invalid, you agree that the remainder of the Terms shall be enforceable.
